Welcome to Harmony CPAP
These Terms & Conditions (“Terms”) govern your access to and use of harmonyhcs.com, the Harmony mobile app, and any related products, services, or communications (collectively, the “Services”) operated by Harmony Healthcare Supply (“Harmony,” “we,” “us,” or “our”).
Please read these Terms carefully. They include a mandatory arbitration provision and class action waiver in Section 16 that affects how disputes are resolved.
1 Acceptance of Terms
By creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, and any additional terms referenced herein.
If you do not agree, please do not use the Services. If you are using the Services on behalf of a business or other entity, you represent that you are authorized to bind that entity to these Terms.
2 Eligibility
To use the Services, you must be:
- At least 18 years old
- A resident of the United States, U.S. territories, or Canada
- Legally able to enter into a binding contract
- Not previously suspended or removed from the Services
Certain products require a valid prescription from a licensed U.S. healthcare provider. See Section 5 for details.
3 Accounts
You may need to create an account to access certain features. You agree to:
- Provide accurate, current, and complete information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Accept responsibility for all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
4 Orders, Pricing & Payment
Order acceptance
All orders are subject to acceptance and product availability. We may refuse, cancel, or limit any order at our discretion, including orders that appear to be placed by automated means, that exceed reasonable quantities, or that contain pricing errors.
Pricing
Prices are listed in U.S. dollars and exclude applicable taxes, shipping, and insurance copays. We make every effort to display pricing accurately, but if a product is listed at an incorrect price due to a typographical or pricing error, we reserve the right to cancel the order and refund any amount charged.
Payment
You authorize us to charge your selected payment method for the total order amount, including taxes and shipping. We accept major credit cards, debit cards, FSA/HSA cards, PayPal, Apple Pay, and Google Pay. Payment processing is handled by PCI-DSS-compliant third parties.
Promotions
Promotional codes are valid only during the promotion period, may not be combined with other offers, and have no cash value. Codes are void where prohibited.
5 Prescription Requirements
CPAP machines, BiPAP devices, and certain related supplies are Class II medical devices regulated by the U.S. Food and Drug Administration. A current, valid prescription from a licensed U.S. healthcare provider is required before we can ship these items.
You may upload your prescription during checkout, email it to rx@harmonyhcs.com, or authorize us to request it directly from your physician's office. Prescriptions are typically valid for one year unless otherwise specified.
Misrepresenting a prescription, forging documents, or providing false provider information is a federal offense and grounds for immediate account termination.
6 Insurance & Billing
Harmony is an in-network provider with most major U.S. insurance plans, including Medicare and many Medicaid programs. When you provide your insurance information, you authorize us to:
- Verify benefits and eligibility
- Obtain prior authorizations on your behalf
- Submit claims and receive payment directly from your carrier (assignment of benefits)
- Bill you for any patient-responsibility amount including deductibles, copays, coinsurance, or non-covered services
You are ultimately responsible for charges your insurance does not cover. We provide a good-faith estimate before shipping but cannot guarantee final coverage amounts, which are determined solely by your insurer.
7 Shipping & Returns
Shipping rates, delivery estimates, returns, refunds, and our 30-Night Comfort Guarantee are governed by our Shipping & Return Policy, which is incorporated into these Terms by reference.
Title and risk of loss pass to you upon delivery to the carrier. Please report damaged or missing shipments within 72 hours of delivery.
8 Medical Disclaimer
Harmony provides medical equipment and supportive sleep-therapy services, but we do not diagnose, treat, or prescribe medical conditions. Content on our website — including blog posts, product descriptions, and customer support — is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
Always consult your physician before starting, stopping, or changing CPAP therapy. If you experience a medical emergency, call 911 immediately.
9 Warranty Disclaimer
All products sold by Harmony are brand new and covered by the original manufacturer's warranty. Specific warranty terms (typically 2 years on CPAP machines, 90 days on masks, 1 year on humidifiers) are described in our Shipping & Returns page.
EXCEPT AS EXPRESSLY STATED, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. HARMONY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HARMONY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES.
In no event will our aggregate liability exceed the greater of (a) the amount you paid Harmony in the twelve (12) months preceding the event giving rise to liability, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so portions of this section may not apply to you.
11 Intellectual Property
The Services, including all text, graphics, logos, images, software, and content, are owned by Harmony or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not reproduce, modify, distribute, scrape, or create derivative works without our prior written permission.
12 Prohibited Conduct
You agree not to:
13 User Content & Reviews
When you submit a review, photo, testimonial, or other content (“User Content”), you grant Harmony a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, display, and distribute it in connection with the Services and our marketing.
You represent that you own or have the rights to share the User Content and that it does not violate anyone's rights or contain anything illegal, obscene, defamatory, or misleading. We may remove or edit User Content at our discretion.
We never compensate reviewers for positive reviews, and reviews verified as “Verified Buyer” are from confirmed Harmony customers.
14 Third-Party Services & Links
The Services may contain links to or integrations with third-party websites or services (such as ResMed myAir, Philips DreamMapper, payment processors, or shipping carriers). We are not responsible for the content, policies, or practices of those third parties. Your use of any third-party service is at your own risk and subject to that third party's terms.
15 Suspension & Termination
You may close your account at any time from your account settings or by emailing support@harmonyhcs.com.
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or are placing the safety of the Services or other users at risk. Sections that by their nature should survive termination (including liability, IP, and dispute resolution) will survive.
16 Dispute Resolution & Arbitration
Informal resolution first
Before filing a claim, you agree to contact us at legal@harmonyhcs.com and try in good faith to resolve the dispute for at least 60 days.
Binding arbitration
If informal resolution fails, any dispute arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Los Angeles County, California, or by video conference at your option.
Class action waiver
You and Harmony each agree to bring claims only in your individual capacity, and not as a plaintiff or class member in any class, collective, or representative action.
Exceptions
Either party may bring qualifying claims in small-claims court, and either party may seek injunctive relief in court for intellectual-property or unauthorized-access claims.
30-day opt-out
You may opt out of arbitration within 30 days of first accepting these Terms by emailing an opt-out notice with your name, address, and account email to legal@harmonyhcs.com.
17 Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. To the extent any claim is permitted to be brought in court (rather than arbitration), the parties consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
18 Changes to These Terms
We may update these Terms from time to time. When we make a material change, we'll update the Effective Date and notify registered users by email or in-app message at least 30 days before the change takes effect.
Continued use of the Services after the effective date means you accept the updated Terms. If you do not agree, please stop using the Services and contact us to close your account.
